8.   What are your rights under this Cookie Policy?

In brief: You have the right to access your personal data, to have them corrected or deleted and to limit or oppose their processing. You are also entitled to data portability. Lastly, you also have the right to withdraw your earlier given consent. In this article we explain how and under what conditions you can exercise these rights.

  • You have the right to request access to all personal data referred to in this Privacy Policy in so far as they relate to you. Twikey reserves the right to charge an administrative fee for multiple subsequent requests for access that are clearly submitted for causing nuisance or harm to Twikey.
  • You have the right to request that the personal data that relate to you and which are incorrect are corrected free of charge. If a correction is requested, this request must be accompanied by evidence that the data for which the correction is requested are incorrect.
  • You have the right to request that your personal data be deleted if they are no longer necessary in the light of the purposes described above. You should, however, take into account that a request for deletion by Twikey will be weighed against:
    • a legitimate interest of Twikey or a third party to keep your personal data, whereby this interest outweighs your right to deletion;
    • a legal or regulatory obligation or a court or administrative order which prevents such deletion.
  • Instead of deleting the data, you can also request that the processing of your personal data be restricted when (a) you dispute the accuracy of those data, (b) the processing is unlawful or (c) the data is no longer required for the purposes described above, while you need them to defend yourself in court proceedings.
  • You have the right to object to the processing of personal data if you are able to prove that there are serious and justified reasons connected with his particular circumstances that warrant such objection. However, if the intended processing qualifies as direct marketing, you have the right to object such processing free of charge and without justification.
  • You have the right to receive the personal data you provided Twikey with, in a structured, commonly used and machine-readable format and you have the right to transfer those data to another controller, where (a) the processing is based on your consent or a contract between you and Twikey and (b) the processing is carried out by automated means.
  • You have the right to withdraw your earlier given consent for processing your personal data.
  • Any request that you address to Twikey can be sent by e-mail to the e-mail address support@twikey.com.

An e-mail with a request to exercise a right will not be interpreted as a consent to process your personal data beyond what is necessary for the treatment of your request. Such a request must clearly state the right you wish to exercise and the reasons for it, if this is required in view of what has been stated above. It must also be dated and signed and accompanied by a digitally scanned copy of your valid identity card that proves your identity.

We will immediately inform you of the receipt of this request. If the request is valid, we will inform you as soon as reasonably possible and no later than thirty (30) days after its receipt.
